I can now advise you that the Authority has made the following decision on the above application:
Decision: No objection subject to conditions and subject to the proviso that the Forestry Commission provides a subsidised all day shuttle minibus service connecting to local service buses to Ambleside from Hawkshead and to Kendal and Barrow at Haverthwaite
Conditions/Reasons:
1 The development hereby permitted shall be commenced before the expiration of THREE years from the date hereof.
REASON: Imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990.
2 The development hereby permitted shall not be carried out otherwise than in complete conformity with the submitted plans as amended by the plan Nos 1A, 2A, 3A, 4A, 5A, 007A, 008A, 09A, 010A, Oil A, 014, 015A, 018A, 020A, 021A, 022A, 023A, 026A, received by the Local Planning Authority on 23 January 2006, and plan Nos 002F,003C and 004C received by the Local Planning Authority on 9 January 2006 and plan No 005C received by the Local Planning Authority on 16 January 2006 and letter received 13 January indicating the provision of a subsidised minibus service.
REASON: For the avoidance of doubt and to ensure a satisfactory standard of appearance of the development.
3 The use of the function room / meeting room / conference room shall be used only in association with the use of other activities at the site and not for business meetings not related to the forest. These rooms shall not be used for social functions including weddings which are not related to the forest operation of the site.
REASON: The site is not suitable for general use for social functions or non related business meetings due to its location in a non sustainable location with poor transport links.
4 No timber treatment shall be applied to existing or new timbers other than those approved by the Local Planning Authority.
REASON: For the avoidance of doubt and to ensure that the development does not harm bats in accordance with Policy NE 13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
5 No wood treatment or external pointing work whatsoever shall be carried out on any buildings between 15 November in one year and 15 April in the following year unless otherwise agreed in writing by the Local Planning Authority.
REASON: To avoid disturbance or injury to bats which may be hibernating in buildings in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
6 Prior to the commencement of any pointing works and during weather conditions when bats are active, a qualified bat consultant shall supervise the manner in which all voids that are to be sealed by pointing are bat free. A report by the bat consultant of action taken will be submitted to the Local Planning Authority within 3 weeks of pointing works being completed for each building.
REASON: To avoid injury to bats which may be roosting in the building in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan. 7 No demolition, wood treatment or construction work whatsoever shall be carried out between 1st May and 30th September in any one year on buildings B, D, I or S unless otherwise agreed in writing by the Local Planning Authority.
REASON:To avoid disturbance or injury to bats which are raising young in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
8 No demolition or construction work whatsoever shall commence on any building between 15 November in one year and 15 April in the following year unless otherwise agreed in writing by the Local Planning Authority.
REASON: To avoid disturbance or injury to bats which may be hibernating in buildings accordance with Policy NE 13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
9 Prior to the commencement of works hereby approved details of proposed external lighting shall be submitted to and agreed in writing by the Local Planning Authority and thereafter shall be implemented in full accordance with the agreed details.
REASON: To ensure use of roosts by bats is not adversely affected in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
10 All roost entrance points identified in the bat survey dated 29th September 2005 on the external walls of buildings that are to be retained will be maintained accessible to bats unless otherwise agreed in writing by the Local Planning Authority.
REASON: To ensure that access by bats to roosts is maintained in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
11 All roost entrances identified in the bat survey dated 29th September 2005 located in roof structures (including the eaves) shall be maintained or reinstated following roofing works. The reinstated features shall be similar in design and in the same position to those identified unless otherwise agreed in writing by the Local Planning Authority.
REASON: To ensure that access by bats to roosts is maintained in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
12 Prior to the commencement of any work on buildings D and E a bat loft shall be installed in building S. Details of the bat loft (including type of access points) shall have been supplied to and approved in writing by the Local Planning Authority prior to the commencement of any works on building S. The approved details shall thereafter be implemented in full and retained in a state accessible by bats unless otherwise agreed in writing by the Local Planning Authority.
REASON: To ensure that adequate roosting sites for brown long eared bats are provided during and after the development in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
13 Prior to the commencement of works on building B features to provide roosting space for bats shall be incorporated into building C. Details of intended roost locations and type of access points shall be supplied to and approved in writing by the Local Planning Authority prior to the commencement of any works on building C. The approved details shall thereafter be implemented in full and retained in a state accessible by bats unless otherwise agreed in writing by the Local Planning Authority.
REASON: To ensure that alternative roosting opportunities are created for bats in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
14 Features to provide roosting space for bats shall be incorporated into the design of buildings L, H, I, Q and Ormandy Barn. Details of the type of feature together with a plan showing the intended roost locations and type of access points shall be supplied to and approved in writing by the Local Planning Authority prior to the commencement of works on each building. The approved features shall be installed prior to bringing these buildings into use and retained in a state accessible by bats thereafter unless otherwise agreed in writing by the Local Planning Authority.
REASON: To ensure that alternative roosting opportunities are created for bats in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
15 Prior to the commencement of any works to building D details of the intended internal design of the walkway passage (including the proposed lighting and ceilings) and details of how access to the roost will be maintained shall be submitted to and agreed in writing by the Local Planning Authority and thereafter shall be implemented in full accordance with the agreed details.
REASON: To ensure that the existing brown-long eared bat roost is not damaged in accordance with Policy NE13 of the Lake District National Park Local Plan and Policy E34 of the emerging Cumbria and Lake District Joint Structure Plan.
16 No development shall take place within the area delineated by a bold black line on the attached plan until the applicants, their agent or successor in title, have secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved in writing by the Local Planning Authority.
REASON: To enable features of archaeological interest to be recorded in advance of development proceeding in accordance with Policy NE16 of the Lake District National Park Local Plan.
17 Prior to the commencement of work on the new staff car park and new pedestrian crossing the traffic calming measures indicated on plan no: ENV4/5/3/003 Rev B (speed limit signs and rumble strips) shall have been agreed by the Local Planning Authority in consultation with the Highway Authority and the staff car park and pedestrian crossing shall not be brought into use until such measures have been fully implemented.
REASON: In the interests of the safety of users of the car park and pedestrian crossing.
18 Details of the surface treatment including samples of materials to be used for the area of the former Hall car park shall have been submitted to and have received the written approval of the Local Planning Authority prior to the laying of any new surface material in this location.
REASON: To ensure a satisfactory standard of appearance of the development.
19 Ormandy Barn shall be used for B1 workshops and for no other purposes (including any other purpose in Class B1 of the Schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision equivalent to that Class in any statutory instrument revoking or re-enacting that Order) and there shall be no direct retail sales of any sort from the barn to the public.
REASON: To ensure that other uses are subject to formal control by the Local Planning Authority to safeguard the amenities of the area.
20 The facing stone to be used in the development hereby permitted shall match (in terms of size, method of laying, pointing and jointing details) the appearance, character, colour and texture of the local stone walls/buildings adjacent to the site.
REASON: For the avoidance of doubt and to ensure a satisfactory standard of appearance of the development.
21 The roof of the buildings and extensions hereby permitted shall be constructed in local slate (where slate is identified as the material to be used) to match existing buildings at the site and which shall be laid in diminishing courses from eaves to ridge.
REASON: To safeguard the character and appearance of the building.
22 Not more than 14 events per year shall be held on the events area without the prior written approval of the Local Planning Authority.
REASON: To safeguard the character and appearance of the area and in the interests of highway safety.
23 The flue on the wood fuel boiler shall be painted in a colour to be agreed in writing by the Local Planning Authority, prior to its installation, and thereafter maintained in the agreed colour.
REASON: In the interests of the visual amenities of the area.
24 Prior to the installation of the glazed screens to the front entrances of Ormandy Barn, details of these glazed screens shall have been submitted to and have received the written approval of the Local Planning Authority, and once approved, thereafter implemented in full accordance with those approved details.
REASON: To ensure a satisfactory standard of appearance of the development .

COMMENT: This extension will take valuable parking space from a restricted area that already causes difficulties for its visitors. Safety is the key issue here: it is quite common for larger vehicles to block the pavement and restrict the vision of motorists on the A593 and customers trying to leave the garage. The site is too small for the size of the business being developed there.
